Summary: Legal advise from panel of lawyers

 For consideration, compiled by GMS Steering Committee 

Under Civil Law, anyone can bring to the Court of Law a 3rd party claim

  1. Time (minimum of 3 years and it could just go on for years);
  2. Cost (Open File costing is between RM10,000 to RM1 Million. This excludes all other costs that will be incurred)
  3. Possible Negative Returns (in the event BNM has a positive decision on the investigation and GMSB is back in operations, your claim will continue)

OTHER MATTERS :

Scenario 1 – For those with physical gold

  1. Continue to hold on. Price appreciation would be your gain at a later time.
  2. For ad-hoc relief –
  • Pawn Shop. The average pawn shop would offer an interest rate of between 1.8% – 2% and the buying price may vary with the estimated price of between RM120 per gram to RM150 per gram pending on the price and the location. This is but an estimated guide.
  • Sell to gold wholesalers. There are several of such avenues depending on your location.
  • Bring your gold to other gold trading companies. Please be advised to look at the gold selling price of the company and make a comparison for on some occasion the difference in pricing would cause a reduction to the weight of gold you have with you.

Scenario 2 – For those waiting for gold to be released and awaiting collection

  1. The release of the company by Bank Negara Malaysia would enable the company to get back into operation and enable you to collect your gold.
  2. In the event Bank Negara Malaysia releases Genneva Malaysia with conditions, subject to the conditions, the company would likely advise on what the decision would be to enable you to collect your gold which may not be 100%. This is but a guide.
  3. Bank Negara Malaysia charges GMSB and the case drags. This is but a guide.

Point  to note  for all consultants and customers :

** Photocopy all the Genneva Malaysia queue number slips. As the slip is of thermal print out, a photocopy of the queue number slips is advisable.

Process to Request for Permit to Assemble as per the Peaceful Assembly Act 2012

 

Like and share — For those planning to hold an assembly/march/rally/gathering in the coming weeks, below FYI, compiled by GMS Steering Committee after meeting with an OCPD on 20 November 2012…

  1. Write a letter to request for permission to assemble at the venue. Address to the person in charge of the venue. E.g. Bukit Jalil, Bank Negara Malaysia, etc (s11 of the PSA 2012)
  2. Wait for the reply from the person in charge. If the reply is positive, proceed to write a letter attentioned to the OCPD nearest to the venue intended for the assembly to request for a permit to assemble at the said venue. The organisers would need to fill up a form that is available at the said police station. (s9 of the PSA 2012)
  3. This letter to request for a permit to assemble needs to be submitted to the OCPD at least 10 days before the proposed date to assemble.
  4. The OCPD would revert within 5 days after the submission of the documents.
  5.  In the event the venue is not suitable, the OCPD would advise the organisers to select another location. Step 2 to Step 4 would need to be repeated with a proposed new date as the compliance to submit the letter to request for a permit would require at least 10 days would apply.
  6. The organisers would also need to ensure the following:
  • The proposed venue is not within 50meters of  hospitals, petrol kiosk, airports, railway stations, places of worship and schools.
  • Persons below the age of 15 cannot participate in the assembly
  • Persons below the age of 21 cannot be part of the organizing committee(organizer)
  • Assemblies in the form of street protest is banned.
  • All who assemble at the venue are considered the responsibility of the organisers. Should the police request for the removal of banners/placards/boards, the organisers must comply immediately. Should the police request for the crowd to be managed, the organisers must cooperate to ensure the crowd is controlled.
  • In the event of failure to comply with the conditions mentioned, the organisers would be held responsible and a fine of up to RM10,000 will be fined onto the organisers.

People's Perception - Let down by the government

Top of everyone’s minds … What are Bank Negara and Barisan Nasional doing now? Why so slow? Who are they really protecting? The above image gone viral on Facebook is the perception of those who are personally affected and whose livelihoods were robbed in broad daylight on 1 October 2012. The majority assumes the authorities are always right and turn a blind eye to those crying for help, human rights and justice until they are personally hit.

Genneva customers who were “sleeping” (not politically conscious or not bothered with what’s happening beyond their backyards) has woken up thanks to BNM’s unjust raid of Genneva Malaysia Sdn Bhd.

By the end of each month since the unjust raid, 60,000 Genneva customers will feel the pinch harder without hibah and consultants will be without their commissions, their livelihoods. What will happen to their dependents from aged parents to children and the sick from all communities and all walks of life?

Customers have gone to UMNO including the highest authority, the Prime Minister who is also the Minister of Finance to plead their case. Yet no answer is forthcoming.

What will Genneva customers do? What is their last recourse for what it is worth? Our take, these Genneva customers and their dependents will not only make it a point to go to the polls at GE-13. They will probably join the awakened citizenry (who upholds integrity, justice, and the rule of law over any other interests is necessary to combat corruption) to CAMPAIGN for the opposition.

Marketing experts will agree nothing beats “word of mouth” and “testimonials” in any marketing campaign, be it products, services or causes. Coupled with social media such as Facebook, Tweeter, etc; hundreds of thousands more will read about Genneva customers plight via Viral Marketing on the internet and on the ground during the General Election campaign period nationwide.

Who is more believable at general election campaigns? The rants of mega scandals and wastage of tax payers money exposed (view list of alleged scandals below) or listen to these Genneva customers and their dependents who tell their own true stories at election campaigns how Bank Negara Malaysia, Ministry of Finance, Ministry of Trade and Consumer Affairs, etc had done them in?

Who holds the top four positions in each Ministry … politicians, elected government voted in by the rakyat at general elections.

When will the next General Election be held? … Anytime before March 2013.

BNM, whatever your plan is on Genneva the most basic act that you should have executed by now is to return the belongings of the public/purchasers. The gold bars, sell back & commission cheques & hibah belongs to the purchasers & consultants. There is no law or act in this world that says you can take away things that have been paid for (daylight robbery). You can continue your investigation as long as you want to & accused Genneva with all sorts of allegations or even create new ones, but please return back what belongs to the purchasers/consultants. You may then take the entire time you want to investigate.

Looking at things now, it indicates that you don’t hear & care for the people of Genneva. Regardless how much effort the clients, consultants & management of Genneva dedicates to resolve this matter in the rightful, etiquette, political & professional manner, you BNM will always portray us as the people who is on the wrong side of the court, no room given to claim & defend our rights.

This is because you are the law, you are above the law, you can manipulate the law, amend the law to tell the world that after 6 years of operating we are wrong, and basically you can do wonders. Even after revealing all Genneva’s biz documents & operation after your recent interrogations with the directors/clients/consultants till today nothing positive or right that you concur Genneva when some of the documents & biz flow is advice, verbally endorsed & directed by BNM during the Feb 2012 audit by BNM.

Please explain why BNM’s Director of legal department Mr Jeremy Tan audited Genneva Malaysia in Feb’12 & the outcome was no issue with the biz & operation model. Mr Jeremy allowed Genneva Malaysia to resume operation but with condition to announce in all major newspapers on who Genneva was. The announcement was made on 27 Feb 2012 in all major newspapers.

You BNM blessed that announcement. You claim that you protect the public, taking away peoples belonging & keeping it for a long period of time is not an act of protecting. At the first place if it’s true that you are protecting you should have done so prior to Tun Dr Mahathir launched of the company, prior to Donald Lim DFM launched of the HQ office in Kuchai Lama. You knew about Genneva’s biz model very well when you raided Genneva Sdn Bhd & yet you let Genneva Malaysia operate all the way till Oct 1st 2012. What is your true intention actually?

BNM’s press statement of the 5th Nov, “The period of non-delivery have in some cases, exceeded five months”. If you are referring this clause to Genneva this is a big lie. Genneva’s delivery has never exceeded that long. All your press statements were general; you refused to specify which gold raided company belongs to which allegations. The way I view it you are cultivating confusion to the public & with the press involvement situations exaggerated. On top of that BNM uses the word “approximately” to reflect the amount of gold seized. For the amount of accounts & cash you sound to be accurate. It has been 37 days after raiding & yet BNM do not know the exact gold seized & again which gold raided company are you referring too? Frankly speaking BNM is not behaving as the world’s best central bank as reported by Global Finance Magazine.

Majlis FATWA, suddenly became silent? When Tun M launched the company Genneva was halal. Maintaining the same biz model till 2012 out of a sudden Genneva became haram in 2012. Why? Now the authorities took away what belongs to the people which they have paid for. What is the “HUKUM” like from the Islamic perspective? Halal? Haram? Out of a sudden the FATWA council just kept silence regarding this. The council should be renamed as THE CUSTOMISED FATWA Council. Why? You stand in the name of religion when there is a hidden need & when issue biases the council or when direction is given by a party who is much powerful then the FATWA council. In other words, in Islam, from the perspective of Malaysia FATWA council, Allah’s law can be overridden. Having saying that, I humbly proposed the council to rename itself as the Malaysia’s Munafiq FATWA council. The teaching of ISLAM & the prophet Muhammad (PBUH) is simple, if you put somebody’s life in misery regardless he/she is a Muslim you have committed a sinful act. I don’t need a PHD in Islamic studies to know that or voicing it out to the FATWA council. I am also conveying the above paragraph to PPIM & Ustaz Zaharudin.

I know that there is a possibility by posting what I have written here I might end up in the Malaysia Citizenship Alert List. I hope I won’t fall into such list because I am a loyal tax payer. I am voicing out what I believe is right. Some people may like/dislike or may not agree/agree with me, I don’t care. There are always 2 sides of a coin. All we want is what belongs to us that we have paid for. Just return it back & let our life’s continue as normal. Please don’t let this crisis drag much longer. Your cooperation & consideration on returning back our belongings is highly appreciated. You have the capability to transform 60,000 daily curses into beautiful prayers, thank you & blessing notes by returning what belongs to us. You are ranked as the world’s best central bank as reported by Global Finance Magazine, you obtained an “A” in your scorecard. Malaysia is ranked the 10th friendliest country by HSBC. PLEASE do not jeopardize all these ranks & titles. Last but not least all we asked for is our gold & money. Thank you.

Saya percaya situasi kewangan kebanyakan warga genneva yang menanti pembayaran hibah/komisen dan kebimbangan samada kita akan mendapat semula emas yang telah dibeli banyak memberi tekanan kuat kepada kehidupan seharian kita semua sejak 1hb Oktober lalu. Hidup kita menjadi terumbang ambing seperti dibadai ombak besar & ramai juga telah mula hilang pertimbangan mencari jalan untuk teruskan kehidupan yang amat sukar dimasa ini.

Kita sudah memohon , meminta , merayu & sebagainya kepada BNM , Tan Sri Zeti & YAB PM iaitu pemimpin yang kita percayai yang akan membela nasib rakyat yang memohon jasabaik mereka ketika dilanda masalah sebegini tapi malangnya semua usaha-usaha yang dibuat nampaknya seperti tidak dipedulikan langsung atau mungkin keberatan untuk mereka turun membantu seperti yag kita harapkan.

Saya percaya kesemua warga Genneva merasai kepahitan yang sama seperti yang saya lalui sekarang dan hidup dalam keadaan bimbang & tertekan setiap saat memikirkan masa depan rumit yang bakal ditempuhi nanti.
